for Expedite FSM

1. Agreement
These Terms & Conditions (“Terms” or “Agreement”) govern your use of Expedite FSM services. By accessing or using our services, you agree to be bound by these Terms.
If you are acting on behalf of a company or other legal entity, you confirm you have authority to bind that entity. If you do not agree, do not use the services.
Expedite FSM reserves the right to update these Terms periodically, with changes effective upon posting or notice via email or in-app notification.
2. Use of Services
– You have a non-exclusive, limited right to use Expedite FSM services per your subscription.
– You control user access and are responsible for all users under your account.
– User accounts and passwords must not be shared between individuals.
– Disputes over user access will be resolved by the subscriber (you).
3. Payment Terms
– Services are billed monthly by bank transfer on the first of each month.
– No long-term contract; cancel anytime with one month’s notice.
– If payment is not received by the first, Expedite FSM may suspend access until payment is received.
– You are responsible for all applicable taxes.
4. GDPR, Data Security, and Privacy
Expedite FSM complies with the General Data Protection Regulation (GDPR) and all applicable data protection laws.
Your data is hosted on servers located in Germany with our trusted infrastructure provider Hetzner Online GmbH, which maintains robust technical and organizational safeguards.

Expedite FSM acts as a data processor; you (the customer) are the data controller responsible for defining data collection purposes and ensuring lawful usage.
We only process data under your instruction, and never for independent commercial purposes.
4.1 Data Collected via OAuth
When you connect your email account via OAuth 2.0, we may collect and process the following data based on the scopes you authorize:
**For Google Accounts:**
– email, profile, openid
– Gmail content and metadata via https://mail.google.com
– Drive file metadata and access (https://www.googleapis.com/auth/drive)
– Tasks content and metadata (https://www.googleapis.com/auth/tasks)
**For Microsoft Accounts:**
– Mail content via https://outlook.office.com/IMAP.AccessAsUser.All, Mail.ReadWrite, Mail.Send, SMTP.Send
– File metadata via Files.ReadWrite, Files.ReadWrite.All
– Group information via Group.Read.All
– User profiles via User.Read, User.Read.All
– openid, profile, email, and offline_access for secure token-based sessions
We request only the minimum required scopes and do not access or store credentials. All access is via time-limited tokens securely encrypted in transit and at rest.
4.2 Lawful Basis & Consent
We process OAuth-connected data solely with your explicit consent, provided during the authorization process.
You can revoke access at any time through your Google or Microsoft account settings.
4.3 Data Subject Rights
You retain full rights under GDPR, including:
– Access to your personal data
– Correction of inaccurate data
– Deletion (“right to be forgotten”)
– Data portability
– Restriction or objection to processing

4.4 Retention & Deletion
OAuth access tokens and associated session data are stored only as long as needed to provide functionality.
If you disconnect your account or delete your user profile, all related OAuth tokens and cached content are securely deleted.
4.5 Security
We implement strict technical and organizational measures, including:
– Encrypted token storage
– Secure HTTPS API calls
– Role-based access control
– Regular security audits
5. Confidentiality
– Both parties will preserve the confidentiality of all shared confidential information.
– Expedite FSM will only use your data as needed to deliver services.
6. Intellectual Property
– All rights to the Expedite FSM platform remain with us.
– Your data remains your property, but you grant Expedite FSM a license to use, store, and back up your data as needed to provide services.
7. Service Changes
Expedite FSM may modify services to improve features or security but will not materially reduce functionality during your paid term.
8. Account Suspension and Termination
– Subscriptions auto-renew monthly unless cancelled with one month’s notice.
– Failure to pay will result in account suspension.
– We may terminate access if you breach these Terms, fail to pay, or become insolvent.
9. Warranties and Limitations
– Services are provided “as is” without warranties.
– We do not guarantee uninterrupted service or that the platform meets all your business needs.
– Our liability is limited to the fees paid by you in the previous three months.
10. Compliance with Google and Microsoft Standards
By using Expedite FSM services, you agree to comply with all applicable policies from Google, Microsoft, and other integrated platforms.
In particular, you agree not to use OAuth connections for:
– Spamming, phishing, or abusive behavior
– Circumventing security restrictions or platform policies
We adhere to the latest requirements set forth by:
– Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy)
– Microsoft API Terms of Use (https://learn.microsoft.com/en-us/legal/microsoft-apis/terms-of-use)
Our OAuth integrations undergo periodic compliance audits and follow strict scope limitation and disclosure standards.

12. Governing Law
These Terms are governed by the laws of England and Wales.
